General terms and conditions for participation in events of Bayerisches Laserzentrum GmbH

1. General / Scope
The following General Terms and Conditions govern the contractual relationship between the customer and participant (hereinafter referred to as "Participant") in seminars, workshops, training courses, conferences, and other knowledge transfer activities (hereinafter referred to as "Events") offered by Bayerisches Laserzentrum GmbH. These General Terms and Conditions apply exclusively. We do not recognize any conflicting or deviating terms and conditions of the Participant unless we have expressly agreed to their validity in writing.

consumerFor the purposes of these terms and conditions, "business persons" are natural persons with whom business relationships are entered into, without these persons being attributable to a commercial or independent professional activity.

entrepreneurFor the purposes of these terms and conditions, "business partner" means natural or legal persons or partnerships with legal capacity with whom a business relationship is entered into who are acting in the exercise of a commercial or independent professional activity.

ParticipantFor the purposes of these terms and conditions, both consumers and entrepreneurs are considered.

2. Registration / Confirmation of Registration
Registration can be done by letter, fax, or email, or online (if available) via the participant or the registering department of their company. Registration becomes legally binding upon our email confirmation or online confirmation (for online registrations). As the number of participants for our events is limited, registrations will be processed in the order they are received.

3. Bank details
Payments are made by bank transfer to the account of Bayerisches Laserzentrum GmbH.

4. Due date and payment, default, set-off
The participation fees are listed in the respective event announcement. They apply to one person and one event date. The participation fee is due 14 days after the invoice date and must be paid in full without any deductions; no discount is granted. After the payment deadline has passed, the participant will be in default even without a reminder.

No fee is charged for credit card payments within the European Union. Credit card payments from non-EU countries may incur additional fees. Participants are solely responsible for any bank charges incurred when paying by bank transfer. Payment by sending cash or checks is not possible; Bayerisches Laserzentrum GmbH accepts no liability for loss. Cash payments on site are not accepted.

In case of late payment, default interest is payable by the business at a rate of 9 percentage points above the base interest rate and by the consumer at a rate of 5 percentage points above the base interest rate. This does not preclude the assertion of further damages for default.

Bayerisches Laserzentrum GmbH reserves the right to prove and claim higher damages for delay against the entrepreneur.

The participant may only offset claims that have been legally established, are ready for adjudication, or have been acknowledged in writing by Bayerisches Laserzentrum GmbH. The participant is only entitled to exercise a right of retention if their counterclaim is based on the same contractual relationship.

5. Cancellations
If the event cannot be held due to force majeure or for other important reasons (e.g., illness of the speaker or insufficient number of participants), participants will be informed as soon as possible and the registration fee will be refunded. Further claims exist only in cases of fault on the part of Bayerisches Laserzentrum GmbH.

Regular participants (non-authors) can cancel their registration up to 14 days before the event for a fee of 50% of the registration fee. After that, or in the event of a no-show, the full registration fee will be charged. Cancellations must be submitted in writing. A substitute participant will be accepted at no additional cost.

Cancellations, withdrawals or rebooking requests must be in writing.

6. Performance
The registration fee includes participation in the event. If conference materials and catering are provided, these are also included in the price. Bayerisches Laserzentrum GmbH reserves the right to replace announced speakers and to make necessary changes to the event program while maintaining the event's integrity.

7. Copyrights
The event materials are protected by copyright. Reproduction, distribution, or other use of the conference materials is only permitted with the express written consent of Bayerisches Laserzentrum GmbH.

8. Liability
Each event is carefully prepared and conducted according to the current state of knowledge. No liability is assumed for advice given, the application of knowledge acquired during the event, or the timeliness, accuracy, and completeness of event materials. Furthermore, no responsibility is assumed.
We assume responsibility for any disadvantages that may arise for participants due to a lack of event prerequisites.

This disclaimer does not apply

– in the case of damage caused intentionally or through gross negligence,

– in the event of a breach of essential contractual obligations, including by legal representatives or vicarious agents of Bayerisches Laserzentrum GmbH; in this respect, liability is limited to the foreseeable, typical, direct average damage according to the nature of the event,

– in the event of culpable injury to the life, body or health of the participant,

– in the case of fraudulently concealed defects and assumed guarantees for information or content of the event documents.

9. Applicable law, jurisdiction and place of performance
German law applies. If the participant is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Erlangen. The same applies if the participant has no general place of jurisdiction in Germany or if their domicile or habitual residence is unknown at the time the action is brought.

10. Final Provisions
The terms and conditions of participation remain binding in their remaining parts even if individual provisions are legally invalid. Any agreements deviating from this contract are only valid if made in writing.
